General terms and conditions
These General Terms & Conditions (GTC) apply to all purchases made from or use of services offered on the website of Performance Polo Ltd., www.performance-polo.com (referred to below as the website). The online products are available only as long as they appear on the website and as long as stocks last. The images displayed on the website are solely illustrative and are absolutely non-binding. The information and statements provided in catalogues and factsheets are solely explanatory and are absolutely non-binding. Performance Polo accepts no responsibility for any errors or inaccuracies in connection with the illustrations, diagrams, explanations, etc. shown in the catalogues and factsheets referred to above or on the website.
1. Scope of application
These general terms and conditions, which Performance Polo Ltd. reserves the right to amend at any time, apply to and govern all orders placed via the website www.performance-polo.com.
2. Order, price and delivery
Performance Polo Ltd. undertakes to honour orders received via its website www.performance-polo.com only insofar as is possible in light of the product stocks available. The product prices are indicated on the website and are payable in Euros.. All prices are shown inclusive of VAT. Applicable VAT will be added for orders delivered to any EU country.. If an item is out of stock or cancelled, it will not be invoiced.. Items are generally shipped with 2-3 days. Delivery depends on your location, but is indicated at checkout.. An online order is definitive once the order confirmation button is activated by the customer.
3. Shipping and pricing
For each order, the delivery and packaging costs are indicated at checkout.
Packages are sent by mail or express parcel services like, but not limited to, DHL, FedEx, TNT or UPS..
4. Invoicing and payment methods
Orders placed on the Performance Polo Ltd. website must be paid for by credit card. VISA and MasterCard are accepted. All online credit card payments are made through a secure server, and the information collected (including the card number and expiry date and/or security code) is encrypted using powerful encryption algorithms. In the event that certain items in the order are out of stock or products are returned (subject to the terms and conditions set out in paragraph 5 below), the amount pertaining to the items in question is credited to the credit card used to place the order, as quickly as possible (within a maximum of 30 days from receipt of the products by Performance Polo Ltd.).
5. Returns
You have the right to return the item(s) you ordered. If you wish to do so, the items must be intact, complete, in their original packaging and bearing their information labels. Items that have been used, soiled or damaged cannot be returned to us, unless it can be proven that the damage took place during transportation or manufacture. If this is the case, once it has been confirmed by us, it will be deemed a faulty return and we will reimburse you the delivery costs in full.
The right of return shall be valid for 14 days from receipt of the goods. If you wish to make a return, the items must be accompanied by the duly completed returns form and a copy of the invoice, and returned to the address below, at the exclusive expense of the sender. Exchanges cannot be made; all items must be returned and reordered directly on the Performance Polo website.
Items sold under discount offers, promotions or clearance sales cannot be returned

6. Data confidentiality
All customer personal data are processed confidentially and are not communicated to third parties by Performance Polo.
Customers are entitled, upon written request, to access, amend or delete data concerning them that are stored and processed in the Performance Polo database. Data such as name, address, email address, item, price, quantity, credit card company and credit card number and expiry date, as well as all other data communicated by the customer, are collected, processed and used in compliance with the legal provisions on data protection in order to process the order and deal with customers.
Performance Polo Ltd. uses the services of Google to audit the quality of its website, in particular by drawing up statistics. Cookies are placed on your computer in order to draw up these statistics. They do not make it possible to identify you personally, but contextual advertising banners may appear during your web browsing following your visits to our website www.performance-polo.com.
7. Applicable law
For all matters not covered herein,English law is the sole legislation applicable to all relations between the Customer and Performance Polo Ltd..
